Terms & Conditions of Proxy Service for Customers

 

This Terms & Conditions of Business agreement (“Agreement”) sets out the basis upon which we, ULEZClaims.co.uk will provide services to you in relation to reclaiming unlawful Low Emission Zone (LEZ) charges. By engaging our services, you agree to be bound by these terms in accordance with UK consumer protection laws and regulatory requirements. 

 

1. Scope of Services 

 

  1. We will process your claim for a refund of unlawful LEZ charges on your behalf. 

  2. Our services include an initial case review, claim submission, and, where necessary, support in legal proceedings. 

  3. We do not provide financial or legal advice beyond the scope of processing LEZ refunds. 

 

2. Fees and Charges

​

  1. A £25 administration fee is required upfront to cover the initial case review and processing costs.

  2. This fee is non-refundable if your claim is found to be outside the scope of successful reclaim cases (e.g., ULEZ charges are not claimable under the current legal ruling). 

 

3. No Guarantee of Refund Without Legal Action

​

  1. Transport for London (TfL) may not voluntarily issue refunds, even in cases where legal rulings have been made against them. 

  2. Previous successful claimants, including Noel Willcox, were required to initiate legal action to enforce the Adjudicator’s ruling. 

  3. We cannot guarantee a refund without the possibility of further legal action. 

 

4. Legal Proceedings & Associated Costs 

 

  1. If legal action is required, you are responsible for any associated court fees. 

  2. Court fees vary based on the amount claimed and are determined by the UK Courts Service as follows:

- £0 - £300 → £35

- £300 - £500 → £50

- £500 - £1,000 → £70

- £1,000 - £1,500 → £80

- £1,500 - £3,000 → £115

- £3,000 - £5,000 → £205

- £5,000 - £10,000 → £455

- Above £10,000 → Higher fees apply based on claim amount.

Note: Court fees must be paid in advance of legal proceedings commencing. 

In the event of a successful claim, statutory interest of 8% on the total refund amount will be retained by us as part of our service fee. 

 

5. Client Responsibilities & Legal Acknowledgment 

 

  1. By engaging our services, you acknowledge and agree that:

  • There is no certainty that TfL will voluntarily issue a refund.

  • Legal proceedings may be necessary to enforce your claim.

  • You accept responsibility for any court fees and associated litigation risks.

  • If a claim is unsuccessful, court fees are non-refundable by either TfL or us.

  • ​You confirm that the information provided in your claim is accurate and complete to the best of your knowledge. 

 

6. Consumer Rights & Cancellation Policy 

 

  1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel this agreement within 14 days of signing without providing a reason. 

  2. To cancel, you must notify us in writing at info@ulezclaims.co.uk within the cooling-off period. 

  3. If you request immediate service commencement within the cooling-off period, you acknowledge that the administration fee remains non-refundable. 

 

7. Data Protection & Confidentiality 

 

  1. We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 

  2. Your personal information will only be used for claim processing and legal purposes where necessary. 

  3. We do not share your data with third parties except as required by law or legal proceedings. 

 

8. Agreement & Proceeding with the Claim 

 

By engaging our services, you:

✔ Agree to pay the non-refundable £25 administration fee. 

✔ Understand that ULEZ charges cannot be reclaimed under this process. 

✔ Acknowledge that legal action may be required to enforce your refund. 

✔ Accept responsibility for any court fees if litigation is necessary. 

✔ Authorise us to retain 8% of your refund amount as statutory interest if the claim is successful.
